Terms of Use

Before anything else

Undupe deletes photographs, and a deleted photograph is the kind of loss that cannot be undone once iOS has finished with it. Section 7 explains exactly what the app can and cannot judge about your pictures, and how it can get a group wrong. It is the most important section on this page. Please read it even if you read nothing else.

1. The agreement

These terms are an agreement between you and RipeSeed LLC, a Delaware limited liability company ("we", "us"), covering the Undupe app for iPhone and this website. By downloading or using Undupe you accept them. If you do not accept them, do not use the app.

Undupe is distributed through the Apple App Store. Your licence to use the app is governed by Apple's Licensed Application End User Licence Agreement, and these terms govern everything Apple's agreement does not — how the app behaves, what we sell, what we disclaim, and how disputes are resolved. Where the two genuinely conflict on the scope of the licence itself, Apple's prevails.

Our Privacy Policy explains what the app collects. It forms part of this agreement.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Undupe on Apple-branded devices you own or control, as permitted by the App Store terms and by Apple's Usage Rules. You may not copy the app, sell or sublicence it, rent it out, reverse-engineer or decompile it except to the extent that law expressly permits despite this restriction, or remove any notice of ownership from it.

3. Eligibility

You must be old enough to form a binding contract where you live, and old enough to hold an Apple ID. If you are using an Apple ID that belongs to a parent or guardian, they are responsible for what happens under it.

4. The free allowance

Scanning is free and unlimited. You may scan your library as often as you like, see every group Undupe finds, see which photo it suggests keeping and why, and compare photographs side by side, without paying anything.

Deleting is metered. Without a paid plan you may delete up to 60 photographs per day. The count resets at midnight in your device's local time zone, does not carry over to the next day, and is tracked on the device rather than against an account — so two devices have two separate allowances.

Because Undupe fills that allowance with whole groups rather than splitting one, a day may end slightly under sixty. That is deliberate: a half-processed group is worse than a smaller number.

The free allowance is not a trial and does not expire. We may change the number for future versions, but we will not reduce it for a plan you have already paid for.

5. What is sold, and what renews

Three paid options remove the daily deletion limit. All prices are in US dollars; Apple sets the equivalent in your local currency, and Apple — not us — takes the payment.

How the yearly subscription renews. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically for a further year unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the period ends. You can manage the subscription and turn off auto-renew in your Apple account settings after purchase.

The other two do not renew at all. The one-month pass gives you 30 days and then stops on its own, with nothing charged on day 31 and nothing sitting in your Apple account waiting to bill you. The lifetime purchase is a single payment covering this app and its future versions. There is no free trial and no introductory offer, so nothing begins charging you a few days after you start.

Launch pricing. The lifetime option is currently offered below its standard price of $24.99. We may end that offer at any time. Ending it never changes what you have already paid.

A paid plan attaches to the Apple ID that bought it and can be restored on your other devices through Restore purchases in the app.

6. Cancelling and refunds

We cannot cancel a subscription for you and we cannot issue a refund, because we never receive the money — Apple does. Both are handled in your Apple account:

Deleting the app does not cancel a subscription. This catches people out constantly. If you remove Undupe from your phone while a yearly subscription is active, it keeps renewing until you cancel it in the Apple settings above.

Where you have a statutory right of withdrawal or cancellation — for example as a consumer in the EEA or the UK — that right stands regardless of anything in this section, and Apple's process is how you exercise it.

7. What Undupe can and cannot judge

This is the section that matters. Please read it properly.

What the app actually does

Undupe measures your photographs and compares those measurements. It computes compact numerical descriptions of what each image looks like, groups photographs whose descriptions are close enough together, and within a group picks a suggested keeper using properties it can measure — how sharp the image is, whether it appears to be an unedited original, and similar signals. It then tells you which reason applied.

What it is not

It is not a judgement about which photograph matters to you, and it cannot be. The app has no way of knowing that the slightly blurry frame is the only one where your grandmother is smiling, that the darker shot is the one with the whole family in it, or that a near-identical pair are actually two different people's rings. It is measuring pixels. You are the only one who knows what the photograph is of.

The concrete ways it can be wrong

Who decides

You do, every time. Nothing is deleted automatically. Undupe marks a suggestion, you review the group, you confirm, and then iOS asks you a second time before anything is removed. The app is a way of finding candidates quickly — the decision is yours, and so is the responsibility for it.

Keep backups. iCloud Photos, an encrypted computer backup, or anything else you trust. Photographs you care about should not exist in only one place, whatever app you use. Our liability for a photograph you chose to delete is limited by section 13.

8. Your photographs are yours

We claim no ownership of, and no licence over, anything in your photo library. Undupe reads your photographs on your device to compare them and deletes the ones you confirm. It does not upload them, publish them, or transmit them to us or to anyone else — see the Privacy Policy. You are responsible for having the right to hold the photographs on your own device.

Undupe, its name, its icon, its interface, its copy and the comparison techniques behind it belong to RipeSeed LLC and are protected by copyright and trade mark law. These terms give you a licence to use the app, and nothing more. Apple, iPhone, iOS and App Store are trade marks of Apple Inc.

11. Changes to the app and to these terms

We may add, change or remove features, and we may update these terms. The dates at the top of this page record when they last changed. A material change — to what is sold, to what renews, or to section 7 — will be signalled in the app rather than only here. Continuing to use Undupe after a change means you accept the revised terms; if you do not, stop using the app. Changes are not retrospective.

If we ever discontinue Undupe, a lifetime purchase means the version you have keeps working on the devices it is installed on for as long as iOS supports it. It is not a promise of perpetual future development.

12. No warranty

To the fullest extent the law allows, Undupe is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted or error-free, that its groupings or keeper suggestions will be correct, or that it will find every duplicate in your library.

Some jurisdictions do not allow the exclusion of implied warranties. Where that is so, this section applies only as far as it lawfully can, and you may have rights that this section does not affect.

13. Limitation of liability

To the fullest extent the law allows, neither RipeSeed LLC nor its members, officers, employees or contractors is liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of data, loss of photographs, loss of profits, or loss of goodwill, arising out of or relating to your use of Undupe — including the deletion of a photograph you confirmed, whether or not the app's suggestion was a good one — even if we have been advised that such loss was possible.

Our total aggregate liability arising out of or relating to Undupe is limited to the greater of the amount you actually paid us for the app in the twelve months before the claim arose, or US $50.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow some of these limitations, and where that is so this section applies only as far as it lawfully can. If you are a consumer, your statutory rights are unaffected.

14. Indemnity

You agree to indemnify and hold harmless RipeSeed LLC against any claim, loss or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the app, or your use of it to delete photographs you had no right to delete.

15. Termination, and what survives

You may end this agreement at any time by deleting the app. We may suspend or end your licence if you materially breach these terms. Ending the agreement does not entitle you to a refund except where the law requires one, and does not cancel a subscription — see section 6.

Sections 7, 8, 10, 12, 13, 14, 16 and 18 survive termination.

16. Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts in Delaware have exclusive jurisdiction, and you and we consent to their jurisdiction and venue.

If you are a consumer resident in the EEA or the UK, nothing here deprives you of the protection of the mandatory consumer law of your country of residence, or of your right to bring proceedings in your local courts.

17. Apple

These terms are between you and RipeSeed LLC only, not with Apple. Apple is not responsible for Undupe or its contents. Specifically:

These terms, with the Privacy Policy, are the entire agreement between us about Undupe. If a provision is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign this agreement; we may assign it to a successor to our business. There is no partnership, agency or employment relationship between us.
